Distance Sales Contract

ARTICLE 1 - SUBJECT OF THE AGREEMENT AND PARTIES

1.1. This agreement establishes the rights, obligations, and legal responsibilities of the parties, as per the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on the Principles and Procedures for Distance Contracts, regarding the sale and delivery of products and services that the Consumer, whose detailed information is provided below, has ordered through the website www.cycatelier.com (hereinafter referred to as the WEBSITE) operated by the Seller.

1.2. The Consumer acknowledges and declares that they have obtained information about the basic characteristics of the goods or services subject to sale, the sale price, payment method, delivery conditions, and all preliminary information related to the goods or services subject to sale and the right of withdrawal, and have confirmed this preliminary information electronically, and then ordered the goods or services in accordance with the provisions of this agreement. The preliminary information provided on the payment page of the website www.cycatelier.com and the invoice are integral parts of this agreement.

ARTICLE 2 - DATE OF THE AGREEMENT

2.1. This agreement is concluded on the date when the Consumer completes their order on the WEBSITE, and a copy of the agreement has been sent to the Consumer's email address.

ARTICLE 3 - PRODUCTS AND SERVICES SUBJECT TO THE AGREEMENT

3.1. The details of the products and services ordered by the Consumer, including their cash sale prices including taxes and quantities, are provided below. All products listed in the table below will be referred to as "Products" from now on.

ARTICLE 4 - DELIVERY OF PRODUCTS

4.1. The Product will be delivered to the address specified by the Consumer on the WEBSITE or to the person/organization at the specified address, properly packaged and in good condition, along with its invoice, within a maximum of 30 days. If it becomes impossible to fulfill the order, the Seller will inform the Consumer within three days and refund all payments received, including delivery costs, if any, within 14 days from the date of notification. The unavailability of the product in stock is not considered an impossibility to fulfill the order.

4.2. If the Product is to be delivered to a person/organization other than the Consumer, the Seller cannot be held responsible if the recipient refuses to accept the delivery.

4.3. The Consumer is responsible for checking the Product at the time of delivery and, if they detect any issue arising from the shipping process, they must not accept the Product and must have the shipping company representative prepare a report. Otherwise, the Seller will not accept responsibility.

ARTICLE 5 - PAYMENT METHOD

5.1. The Consumer acknowledges, declares, and undertakes that, since installment sales are made only with credit cards belonging to banks, they will confirm the relevant interest rates and default interest from their bank, and that the provisions regarding interest and default interest will be applied in accordance with the credit card agreement between the Bank and the Consumer, as per the applicable legislation. The installment payment facilities provided by institutions such as banks and financial institutions, which provide credit cards, installment cards, etc., constitute a credit and/or installment payment facility directly provided by the mentioned institution; the product sales made in this context and for which the Seller has received the full payment are not considered installment sales but cash sales under this Agreement. The Seller's legal rights in cases legally considered installment sales (including the right to terminate the agreement and/or demand the full remaining debt with default interest in case of non-payment of any installment) remain intact. In case of the Consumer's default, a monthly default interest rate of 5% will be applied.

ARTICLE 6 - GENERAL PROVISIONS

6.1. The Consumer acknowledges that they have read and been informed about the essential characteristics of the products displayed on the WEBSITE, their sale price, payment method, and delivery conditions, and have confirmed this information electronically for the sale.

6.2. By electronically confirming this agreement, the Consumer confirms that they have accurately and fully received the necessary preliminary information, including the address to be provided by the Seller to the Consumer before the conclusion of the distance contracts, the basic characteristics of the products ordered, the price of the products including taxes, and the payment and delivery information, as well as information regarding the right of withdrawal.

6.3. The Seller is responsible for delivering the product subject to the agreement in a sound, complete manner, in accordance with the specifications mentioned in the order, and with warranty certificates and user manuals, if any.

6.4. The Seller may provide a different product of equal quality and price to the Consumer before the fulfillment period of the contractual performance obligation expires.

6.5. If the Seller cannot fulfill the obligations of the agreement for the product or service due to impossibility, the Seller shall inform the Consumer before the fulfillment period of the contractual performance obligation expires and may provide a different product of equal quality and price to the Consumer.

6.6. For the delivery of the product subject to the agreement, a signed copy of this agreement must be sent electronically to the Seller, and the payment must be made in the manner preferred by the Consumer. If for any reason the product price is not paid or is canceled in the bank records, the Seller shall be deemed to be released from the obligation to deliver the product.

6.7. After the delivery of the product, if the product price is not paid by the bank or financial institution to the Seller for any reason, the Consumer must return the product to the Seller within 3 days, with all costs to be borne by the Consumer. All contractual and legal rights of the Seller, including pursuing the receivable of the product price, remain intact.

6.8. If it becomes impossible to fulfill the order, the Seller shall inform the Consumer within three days of learning of this situation and shall refund all payments received, including delivery costs, if any, within 14 days from the date of notification. The unavailability of the product in stock is not considered an impossibility to fulfill the order.

ARTICLE 7 - PRODUCT DELIVERY PROCESSES

7.1. The Product will be delivered to the address specified by the Consumer on the WEBSITE or to the person/organization at the specified address, properly packaged and in good condition, along with its invoice, within a maximum of 30 days. ARTICLE 8 - RIGHT OF WITHDRAWAL

As per the relevant provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts:

8.1. The Consumer has the right to withdraw from the distance contract regarding the sale of goods within 14 (fourteen) days from the date of receiving the goods, without providing any reason and without incurring any penalty. However, the Consumer may also exercise the right of withdrawal during the period from the conclusion of this Agreement to the delivery of the goods. It is sufficient for the notification regarding the exercise of the right of withdrawal to be directed to the Seller or provider in writing or via a permanent data storage device within this period. To exercise the right of withdrawal, our customers must complete the return form provided with the product and return the product to the courier company along with the return form.

For the determination of the withdrawal period:

a) For goods that are subject to a single order and delivered separately, the day the Consumer or a third party designated by the Consumer receives the last item,
b) For goods consisting of multiple parts, the day the Consumer or a third party designated by the Consumer receives the last part,
c) For contracts where goods are delivered regularly over a certain period, the day the Consumer or a third party designated by the Consumer receives the first item, shall be taken as the basis.

8.2. The Consumer's right of withdrawal does not apply to:

a) Goods prepared according to the Consumer's requests or personal needs,
b) Goods that are perishable or may expire soon,
c) Goods whose protective elements such as packaging, tape, seal, or package have been opened after delivery and which are unsuitable for return due to health and hygiene reasons,
d) Goods that are mixed with other products after delivery and cannot be separated by their nature,
e) Books, digital content, and computer consumables provided in a tangible medium, if the protective elements such as packaging, tape, seal, or package have been opened after delivery,
f) Periodicals such as newspapers and magazines, except those provided under a subscription agreement,
g) Services performed immediately in the electronic environment or intangible goods delivered immediately to the Consumer,
h) Services initiated with the approval of the Consumer before the right of withdrawal period expires, and
i) The delivery of goods that have been or are installed according to the Consumer's requests or needs.

8.3. For the return of goods:

a) The returned product must be sent to the return address with all accessories and in the original packaging.
b) The consumer must bear the shipping cost unless agreed otherwise with the Seller.

ARTICLE 9 - CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The Consumer may not exercise the right of withdrawal in the following cases:

a) Goods that are prepared according to the Consumer's requests or personal needs,
b) Goods that are perishable or may expire soon,
c) Goods whose protective elements such as packaging, tape, seal, or package have been opened after delivery and which are unsuitable for return due to health and hygiene reasons,
d) Goods that are mixed with other products after delivery and cannot be separated by their nature,
e) Books, digital content, and computer consumables provided in a tangible medium, if the protective elements such as packaging, tape, seal, or package have been opened after delivery,
f) Periodicals such as newspapers and magazines, except those provided under a subscription agreement,
g) Services performed immediately in the electronic environment or intangible goods delivered immediately to the Consumer,
h) Services initiated with the approval of the Consumer before the right of withdrawal period expires,
i) The delivery of goods that have been or are installed according to the Consumer's requests or needs.

ARTICLE 10 - SETTLEMENT OF DISPUTES

For complaints and objections, the Consumer may apply to the consumer arbitration committees or consumer courts at their place of residence or where the transaction is carried out, as per the monetary limits determined by the Ministry of Trade in December of each year.

ARTICLE 11 - ENTRY INTO FORCE

This Agreement has been read and accepted electronically by the parties, and has entered into force after the Consumer made the payment, following the acceptance of the order placed on the WEBSITE by the Seller.
This Agreement is provided to the Consumer via email upon acceptance.
